(CLEVELAND) — The death of a 12-year-old boy who was shot by police in Cleveland last month has been ruled a homicide.

The Cuyahoga County Medical Examiner’s office said on Friday that Tamir Rice died from a single gunshot wound to the torso that damaged a vein, his intestines and his pelvis.

Surveillance video showed the boy was shot by an officer no more than two seconds after a patrol car stopped him at a Cleveland park.

A 911 caller had reported someone waiving a gun that turned out to be an airsoft pellet gun. The rookie officer who shot Rice thought it was real.

A grand jury is now considering whether the homicide was justifiable.
