The charges against a 55-year-old man accused of trespassing on Taylor Swift’s property in Rhode Island have been dropped due to a lack of evidence.

The Westerly Sun reports that a judge dismissed the charges against Joseph L. Bernatche on Friday, saying that it would be too difficult to prove “beyond a doubt” that Bernatche was actually trespassing on Taylor’s property when he passed a note meant for her to one of her security guards.  What can’t be proven definitively is whether or not the guard was at the property’s gate when he accepted the note, or whether had walked a little ways down the road and onto public property.

The note, by the way, read, “Taylor if you ever want to see me in person again, I suggest you call me now, Joe.”  Apparently, Bernatche believed that he was destined to meet Taylor, though the two never actually have.  He hasn’t even been to a Taylor concert.

Bernatche’s lawyer told the paper that it didn’t surprise him that the charges were dropped, and pointed out that had the case gone to trial, it would have been a “real circus” atmosphere.
